1. Eligibility Restrictions: Warriors’ Best Friend’s truck giveaway is open only to individuals who are legal residents of the fifty (50) United States (including the District of Columbia) and are 21 years of age or older. Employees of Warriors’ Best Friend Foundation, their advertising or promotion agencies, those involved in the production, development, implementation or handling of Giveaways, any agents acting for, or on behalf of the above entities, their respective parent companies, officers, directors, subsidiaries, affiliates, licensees, service providers and/or the immediate family (spouse, parents, siblings and children) and household members (whether related or not) of each such employee, are not eligible. Title and Presenting Sponsors will be provided a certain level of entries for inclusion in the listed Entry Periods stated within these Official Contest Rules as well as a separate specific Entry Period. Winning a prize is contingent upon fulfilling all the requirements set forth in the Official Rules. Void where prohibited by law.
2. Agreement to Official Rules: By participating in the Giveaway, each Entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of Warriors’ Best Friend Foundation, which are final and binding in all matters relating to the Giveaway. The Giveaway will be run in accordance with the Official Rules, subject to amendment by Warriors’ Best Friend Foundation. Each Entrant must comply with the Official Rules and will be deemed to have received and understood the Official Rules by participating in the Giveaway. If any provisions of the Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. Warriors’ Best Friend's failure to enforce any term of these Official Rules will not constitute a waiver of that provision.
3. Prize and Approximate Retail Value (ARV): The prize available to be won in the Giveaway is one (1) 2015 GMC Sierra 1500 Crew Cab short box SLT. VIN 3GTU2VEC7FG342027. The prize in its original state is valued at MSRP $49,620.00 (Addendum for Aftermarket work – $5,860.00) Total Price – $55,480.00—from which sales tax for the vehicle will be configured. No cash or other substitution may be made. The Winner is responsible for any taxes and fees associated with receipt or use of the prize. 4. Entry Period: Giveaway Time Period is open May 29th 2015 through October 30th 2015. All entries must be received by 8:30PM CT on October 30, 2015 (the “Giveaway Time Period”). It is anticipated that there will be 15 specific Entry Periods during the Giveaway Time Period typically following an event such as a KC Live! Friday Night Concert in the Power & Light District. All entries if purchased from the Warriors’ Best Friend booth from June 13th beginning 12:01AM and before 12:00AM October 30th will be placed in one Entry Period. If during this time frame an entrant purchases raffle ticket(s) within a bar/restaurant that is participating in the Giveaway, this entry will be placed in a separate Entry Period. All tickets received within this bar/restaurant will be placed in one separate drawing, and one entrant will be selected as a Finalist to proceed to Warriors’ Best Friend Truck Giveaway Presentation on Military Appreciation Night in the Power & Light District. It is anticipate that there will be 10 participating bar/restaurants in the Giveaway. However, Warriors’ Best Friend reserves the right to combine certain events into one Entry Period. See Paragraph 7 below for details on the Drawing.
5. How to Enter: To enter the Giveaway
A. Register in person with Warriors’ Best Friend Foundation
B. Register with a participating bar/restaurant
C. Register on the Giveaway site.
Submission will result in one (1) entry per every $5.00 donation. The use of any agencies or automated software to submit entries is prohibited. All entries must include your full name, phone number, e-mail and date of birth. Warriors’ Best Friend is not responsible for lost, stolen, mangled, misdelivered, illegible, untimely entries or for entries not received. Entries shall be the property of Warriors’ Best Friend Foundation, and the Kansas City Power & Light District and will not be returned for any reason. By entry into the Giveaway, each entrant gives Warriors’ Best Friend Foundation and Kansas City Power & Light District permission to use the information provided in the registration for a variety of activities, including promotional offers.
6. General Conditions: In the event that the operation, security, or administration of the Giveaway is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, Warriors’ Best Friend may, in its sole discretion, either: (a) suspend the Giveaway to address the impairment and then resume the Giveaway in a
manner that best conforms to the spirit of these Official Rules; or (b) award the prizes at random from among the eligible entries received up to the time of the impairment. Warriors’ Best Friend reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, Warriors’ Best Friend reserves the right to seek damages from any such person to the fullest extent permitted by law. Warriors’ Best Friend’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
In case of a dispute as to the owner of an entry, entry will be deemed to have been submitted by the authorized account holder of the screen name from which the entry is made. The authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
All Entries must be received during the Entry Period to be eligible for the Giveaway. Any Entry received after the Entry Period will be void. Neither Warriors’ Best Friend Foundation nor any service providers are responsible for incorrect transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures or any telephone network, computer equipment, software, inability to access any website or online service, or any other error or malfunction, or late, lost, illegible, incomplete, damages, or misdirected Entries or Entries not properly forwarded to Warriors’ Best Friend Foundation.
7. Drawing: A representative of Warriors’ Best Friend Foundation will select Finalists in a random drawing of all eligible entries received during each Entry Period. Each Entry Period one (1) person will be selected and given a key (the “Entry Period Key Holder”). The odds of being selected as the Entry Period Key Holder will depend on the number of eligible entries received during the Entry Period. The potential Entry Period Key Holder must answer the phone when called in order to receive a key and become a Finalist in the Giveaway. Only one phone call will be made. If the call goes to voicemail, the Entry will be disqualified. The potential Entry Period Key Holder will be asked to verify the information on the registration card. If not present, the potential Entry Period Key Holder must provide proof of identity and driver’s license within one week following the drawing. If the potential Entry Period Key Holder is not present or does not answer his/her phone when the call is made, the Warriors’ Best Friend representative will select a new potential Entry Period Key Holder in his/her place at random from all entries received during the Entry Period. Limit one (1) key, per household, per Giveaway.
On Monday, November 7, 2015 all Entry Period Key Holders must be present at the Warriors’ Best Friend Truck Giveaway Presentation located at the Kansas Power & Light District. If any Entry Period Key Holder is not present in person, a Warriors’ Best Friend representative may conduct another drawing from all the entries submitted over the course of the Giveaway until all spots have been filled. All Entry Period Key Holders must have Driver’s License or other government issued ID to verify their identity. The presentation will feature chests lined up in a row on stage. Entry Period Key Holders (or any substitutes as described above) will draw a number at random assigned to a chest located on the stage. One of the chests will contain the key that will start the truck featured in the Giveaway and will be declared the Winner of the Giveaway Prize (the “Winner”).
8. Requirements of the Potential Winners: All federal, state, and local taxes, and all other costs associated with acceptance or use of the Prize, including all license and document fees, are the sole responsibility of the Winner. The Winner also will be required to provide a valid driver's license and show proof of automobile liability insurance or any other state automobile insurance requirements prior to taking possession of the Prize. The Winner may waive his/her right to receive the Prize. If the Winner waives his right to receive the Prize a representative of Warriors’ Best Friend will conduct a random drawing from the remaining Entry Period Key Holders for the Prize. The Prize has no cash value, is non-transferable, non-exchangeable, and non-refundable, and must be accepted by the Winner as awarded. The ARV of the Prize is based on available information provided to Reed Buick GMC Dealership. As a condition for acceptance of the Prize, the Winner must provide Warriors’ Best Friend with valid identification and a valid taxpayer identification number or social security number before the Prize will be awarded. Since the ARV of the Prize is over $600, the Winner will receive from Warriors’ Best Friend an IRS form 1099 at the end of the calendar year for tax purposes as required by law, a copy of such form will be filed with the IRS.
The Winner will be scheduled a time within thirty (30) days to allow for them to pick up their prize from Reed Buick GMC Dealership at the dealer’s location in Kansas City, Missouri.
9. Release and Limitations of Liability: By participating in the Giveaway, entrants agree to release and hold harmless the Giveaway Entities from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Giveaway; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, misdirected, or undelivered electronic submissions; (e) errors in the administration of the Giveaway or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Giveaway or receipt of any prize. Entrant further agrees that in any cause of action, the Giveaway Entities' liability will be limited to the cost of entering and participating in the Giveaway, and in no event shall the Giveaway Entities be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
